Purpose

I take good care of your information.

When you are a customer with me or you are photographed by me, I process images and the information you give me in accordance with the personal data law. I have the copyright to the pictures I take.
In the case of portrait photography, I obtain the consent of the people who are on my pictures.
I also record information necessary to identify the people I am photographing.
In addition, I register information which will allow me to bill my customers and comply with the billing rules and send invoices via email.

I have entered into data processing agreements with the companies I use to make image processing and storage of my images as well as with companies that respectively host my website and perform accounting work to ensure that the privacy policy rules are followed and met by GDPR.

When I photograph portraits or other images where people are recognizable, I have obtained the consent of the people who appear on the images so that I may use the images in my marketing, if applicable and / or keep the images in stock for up to 2 years. In special cases, I may be forced by other laws to disclose information to authorities, insurance companies, banks or others who have legitimate access to the information.


The basis for processing personal data

The processing of personal data is made in order to comply with an agreement regarding the sale of my images or photo sessions.

Categories of personal information and their source
Contact information is collected in the form of name, address and e-mail and, if applicable, company appointment or information about who ordered the pictures. Only personal information collected regarding photographed person or the company I make deals with is disclosed to me.

I only store and use information about you that is necessary for me to perform my task and to comply with the authorities or other requirements for documentation.

Recipients of personal data
The personal information provided as contact information will not be disclosed outside of my business unless a separate agreement has been made with that company that has commissioned me and where the photographed person has agreed to participate in the photo session or because it is necessary as a result of others legitimate requirements, see above about authorities etc.

Storage of information
The portraits and images for which consent is required and to which I have the copyright are stored for up to 2 years in my archive and then permanently deleted.
The personal data for the purposes of the Accounting Act are kept for 5 years after the end of the financial year and are subsequently deleted.

Access your information
If you know or have a presumption that I process personal information about you, you have a number of rights in relation to the treatment.

Once I have received your inquiry and checked if you are the one you publish to – to ensure that I do not provide personal information to unauthorized persons, the following applies:

The right to insight
You have the right to request insight into the personal information I am processing about you.
You have consented to me being able to use your photo and what it is to be used for. This consent has been given either verbally or in writing, and you have the right to withdraw your consent at any time.

The right to protest
You have the right to protest if you disagree with my processing of your personal information. I will in each case assess whether your protest is justified.

The right to request deletion
You are entitled to request that your information and images be deleted. This right is not final as certain data cannot be deleted due to other legislation or if agreement and purpose entitle me to retain personal data and images.

The right to request rectification
You are entitled to rectify incorrect information.

The right to data portability
You are entitled to obtain your information in a technically legible format. Please note that this is only the personal information you have provided. If you want to obtain your images, they may only be for private use, as I have the copyright to the images. If you wish to use the images commercially or for publication, then you have to pay for them and I can only sell the images to you if it complies with the agreement I have made with 3rd-party. Otherwise, the image will be deleted and not handed over.

The right to withdraw consent
When I take photos of people, this will typically be based on consent and you will therefore be able to withdraw your consent at any time. I am only entitled to retain information to be used as documentation to authorities, insurance companies, banks or others who have legitimate access to the information.

The right to appeal
You are always welcome to contact me if you have any questions or wish to complain about my processing of your personal information. If you are not satisfied with my response, you can make an appeal to the Data Inspectorate (Datatilsynet) who is the authority that keeps track of whether your information is processed correctly. You can send a complaint to dt@datatilsynet.dk.
